By accessing or using the X On-Call platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

X On-Call is an automated temporary staffing platform that connects facilities with qualified, available staff. The Service includes:

• Staffing request submission and management
• SMS and email notifications to on-call staff
• Two-way SMS acknowledgment and reply functionality
• On-call schedule reminders sent via SMS
• Double-confirmation workflows to verify staff commitment

3. SMS Messaging

By providing your mobile phone number and using the Service, you consent to receive text messages from X On-Call, including:

• Staffing opportunity notifications and alerts
• On-call schedule reminders
• Two-way acknowledgment messages requiring a reply
• Shift confirmation and cancellation notices

Message frequency varies based on your role and activity. Standard message and data rates may apply. You may opt out at any time by replying STOP to any text message. Reply HELP for assistance.

X On-Call does not send promotional or marketing SMS messages. All texts are transactional and directly related to your use of the Service.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Submit false or misleading staffing information

6. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. X On-Call does not guarantee that the Service will be uninterrupted, error-free, or that staffing requests will always be fulfilled.

7. Limitation of Liability

To the maximum extent permitted by law, X On-Call shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

8. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions.
